Collection of Protected Health Information (“PHI”) and Additional Health Information
We may come in contact with your Protected Health Information (“PHI”) and Additional Health Information as we are a Business Associate to covered entities under the federal Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). We may need to access your PHI to perform certain services. We take efforts to protect your PHI and only use and disclose it as necessary to perform services for providers and other uses allowed by applicable law. Our use and disclosure of PHI is further limited by HIPAA and the Notice of Privacy Practices available from Providers.
“Protected Health Information” is individually identifiable health information which is created or received by or on behalf of a covered entity (for example, a health care provider or health plan) and which relates to the past, present or future physical or mental health or condition of an individual, the provision of health care to an individual, or the past, present or future payment for the provision of health care to an individual. PHI is further defined by and is subject to HIPAA.
“Additional Health Information” is a subset of Health Information that does not fall within the category of PHI above. For example, this would encompass information related to past, present or future physical or mental health or conditions, the provision of health care to an individual, or the past, present or future payment for the provision of health care to an individual but with the difference that such information was not created or received by us from or on behalf of a covered entity. We may collect Additional Health Information in connection with the Site or Applications.
Personal Information About Users Under 18 Years of Age Not Collected
The Site is meant for adults and those who have reached the age of majority as defined by the laws of their domicile. The Site is not meant for individuals under the age of eighteen (18) or those defined by the laws of their domicile as minors. Nonetheless, this Privacy Policy is still designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) to the extent COPPA applies. Accordingly, we do not knowingly collect or retain any personal information about users under the age of thirteen (13). How We May Use and Disclose Your Personal Health Information (“PHI”)
We may use and disclose PHI to provide Services to the patient or the covered entities, for those uses and disclosures permitted by HIPAA, and the agreement that we have with covered entities. In the event that there is a conflict or inconsistency about the handling of PHI between: (i) this Privacy Policy; and (ii) our compliance obligations with HIPAA, any and all applicable laws regarding PHI, and contractual commitments with Providers, then the latter will govern.
